Warranty

Effective from November 1st, 2023.

 

Cactus Equipments Inc., operating under its trademark “CactusRack”, stands behind the quality and craftsmanship of its products and offers a Limited 2 Years Warranty to the original retail purchaser from the date of purchase. This warranty remains valid for two (2) years from the date of
purchase as long as the product has not been transferred to another person.

 

Warranty Coverage:

Subject to the terms and conditions outlined in this warranty, Cactus Equipments Inc. (below CactusRack) will address defects in materials or workmanship by either repairing or replacing a defective product. This warranty covers parts and labor at no cost to the original retail purchaser.

 In addition, CactusRack may, at its discretion, choose not to repair or replace a defective product but instead offer a refund equal to the purchase price paid for the product or a credit that can be used towards the purchase of a new CactusRack load carrier system.

 

Warranty Limitations:

This warranty does not cover defects caused by normal wear and tear, cosmetic issues, accidents, unlawful vehicle operation, or unauthorized modifications or repairs to a load carrier system.

 

Defects resulting from conditions beyond CactusRack's control, such as misuse, overloading, or failure to use the product in accordance with CactusRack's written instructions and guidelines, are not covered by this warranty.

 

Making a Warranty Claim:

If a defect in the product becomes apparent, the original retail purchaser should initially contact the CactusRack dealer from whom the product was purchased. If the dealer can’t address the defect, the original retail purchaser should contact CactusRack using the contact information provided below.

 

Should it be necessary to return a product to CactusRack, a CactusRack technician will provide the original retail purchaser with the appropriate mailing address and any additional instructions. Please note that the original retail purchaser is responsible for the cost of shipping the product to CactusRack. Additionally, the mailing must include proof of purchase in the form of the original purchase invoice or receipt, along with a detailed description of the defect.

 

Disclaimer of Liability:

Repair or replacement of a defective product or the issuance of a refund or credit (as determined by CactusRack) is the exclusive remedy under this warranty. CactusRack shall not be held responsible for any damage to a purchaser's vehicle, cargo, or any other person or property.

 

This warranty supersedes all other warranties, whether express or implied, including but not limited to the warranties of merchantability and fitness for a particular purpose.

 

CactusRack's sole liability to any purchaser is limited to the remedies specified in this warranty. In no event shall CactusRack be liable for any lost profits, lost sales, or any consequential, direct, indirect, incidental, special, exemplary, or punitive damages or any other damages of any kind or nature.

 

Some states may not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply.
